TERMS AND CONDITIONS
Shipping
Should clients want to arrange their own shipping it must be specified when order is placed. Shipping and handling charges are additional and will be included on the invoice. Client is responsible for these costs. While Pather strives for prompt delivery, in the event of a delay the company accepts no responsibility. If client requests specific packaging requirements, additional charges may be applied.
Typically orders received after 12:00 pm EST on operating business days will be shipped in priority sequence the following day. All shipments unless otherwise specified will be shipped via FedEx.
Handling
For an order that requires more than 2 shipping locations, ___ will be charged for each additional location. Multiple location destinations must be specified at time of order.
Quotations
Price quotes expire 14 days after issue date. Distributor pricing is available.
Payment and Order Processing
All new customers paying by C.O.D. must have an approved credit application on file. Please allow 3 - 5 business days for approval of credit application. A Pather team member will be more than happy to guide you through this process. A standard term of Net 30 days contingent on credit check is protocol for all non-credit card orders.
Prices
All prices are subject to change without notice. A 2% interest per month will be effective on all outstanding balances.
Tax
Pather has the right to charge client any taxes that may occur in association with sales, purchases, and deliveries of any products sold. These costs will be shown separately on invoices. PST tax exemption is possible with valid government issued tax exemption number. All tax exemption arrangements must be made at time of purchase.
Custom Orders
To place a custom order, clients have the option of calling the office to speak to a Pather team member, sending a fax or an e-mail ATTN: P2 Custom Order. Custom orders require a 50% deposit once the prototype has been approved. There is no guaranteed shipping time on custom orders. In the event of a cancellation, the initial deposit will not be refunded and additional charges related to production will be made. Prototypes are subject to material and labour cost fees.
Minimum Order
There are no minimum purchase requirements.
Damages and Claims
It is the client’s responsibility to count and inspect received shipment since breakage may occur during transit. Damage claim must be made within 24 hours of receiving shipment. Claims made after this time period will not be credited. Pather is not responsible for any damage that may occur during transit. Client is responsible for using Pather products only for which they are crafted. Client is liable for any harm caused by misuse of product.
Upon discovery of an unfulfilled order, it is the client’s responsibility to notify a Pather team member within 24 hours of receiving the short shipment. Upon satisfactory investigation, the outstanding piece(s) will be shipped the next day free of charge.
Returns Pather must be contacted in the event of a return in order for the item to be assigned an RAN number. Once an RAN number has been assigned, a Pather team member will give further instruction on the return procedure. No return will be accepted unless it can be identified with an RAN number. Returns can be made within 14 days after shipping date and are subject to a 25% restocking charge. Client is responsible for courier arrangement and fees.
Products must be returned in its original packaging and all additional costs will be the responsibility of the client. If returned product arrives damaged due to transit and inadequate packaging, customer will not be refunded.
Refund
Client will receive refund on the basis that a 25% restocking fee will be charged and all shipping fees will be the responsibility of the client. Returns will be fulfilled using same method of payment.
Warranty
At Pather International there is no expressed or implied warranty on our products. Any arrived shipment proving defective in craftsmanship or material may be replaced or returned. All shipment costs involved in bringing product back to Pather will be the responsibility of the client. Defective merchandise must be received before replacement piece is sent out. Shipment of replacement piece will be free of charge.
Cancellation
Cancellations will only be accepted if authorized within 24 hours after order has been placed and will be considered on a per order basis. To cancel an order, client must submit a written cancellation by fax or e-mail.
Should the cancellation request be made after the order has been fulfilled, clients are liable for all return shipping fees, all standard restocking charges, and any other fees that may be associated with the cancellation.
Backorder
If an item is not in stock at time of order, it will be shipped as soon as possible. Delivery time for backorders will be determined on a per order basis and varies depending on the product.
